No win, no fee lawyers can have great difficulty in deciding whether or not a plaintiff’s case is meritorious. The difficulty arises because significant costs can be involved in procuring appropriate preliminary opinions and the solicitor has a limited knowledge of orthopaedic surgery.
Informal discussions with a friendly orthopaedic surgeon can be invaluable. I perform this service pro bono. I do so predominantly out of sympathy for the plaintiff, but I am cognisant of the difficulties that the solicitors face.
Maybe you should ask your orthopaedic surgeon to act similarly.
